These Best Offer of the Season Promotion Terms and Conditions (“Promotion Terms”) govern the Best Offer of the Season promotion (the “Promotion”) offered by EverPass Media II, LLC (“EverPass”). By participating in the Promotion, Customer agrees to these Promotion Terms and to the applicable EverPass Master Subscription Agreement and/or Subscription Terms (collectively, the “Agreement”). In the event of any conflict between these Promotion Terms and the Agreement, these Promotion Terms will control solely with respect to the Promotion.

The Best Offer of the Season Promotion begins April 1, 2026 at 12:00 a.m. ET and ends April 27, 2026 at 11:59 p.m. ET, unless extended by EverPass in its sole discretion (the “Promotion Period”). EverPass reserves the right to modify, suspend, or terminate the Promotion at any time in its sole discretion; however, any such modification or termination will not materially affect orders accepted during the Promotion Period.

The Promotion is available only to commercial establishments physically located in the United States, U.S. Virgin Islands, or Puerto Rico that purchase NFL Sunday Ticket via EverPass for commercial use, satisfy EverPass credit and account requirements, and activate qualifying Services during the Promotion Period. The Promotion is void where prohibited by law. This Promotion is limited to bars and restaurants and is not valid for any group deals, casinos, or sportsbook venues. Customer must maintain eligibility throughout the applicable Subscription Term to retain promotional pricing. EverPass may verify Customer eligibility at any time during the Promotion Period and the Subscription Term. If EverPass determines that a Customer is or has become ineligible, or has misrepresented its eligibility, EverPass may, in its sole discretion, revoke any promotional benefits and charge Customer the then-current standard commercial rates retroactively from the start of the applicable Subscription Term, and Customer shall reimburse EverPass for the full retail value of any equipment provided at no charge under this Promotion.

Eligible new EverPass customers who are also new NFL Sunday Ticket subscribers will receive, per qualifying commercial location: (i) for the Initial Term of their NFL Sunday Ticket Subscription, forty percent (40%) off the NFL Sunday Ticket commercial rack rate, up to a maximum discount of $2,500 per location; (ii) for the Initial Term (twelve (12) months), fifty percent (50%) off of an annual EverPass Core Subscription; (iii) two (2) commercial-grade streaming devices at no charge (model and specifications determined by EverPass); and (iv) one (1) EverPass bar kit at no charge, while supplies last. An active EverPass Core Subscription is required to access NFL Sunday Ticket via EverPass. Following Customer’s Initial Term for NFL Sunday Ticket and EverPass Core, or otherwise upon exhaustion of the Promotion (i.e., once the maximum promotional value has been reached), Customer will be charged the then-current standard commercial rates. The total promotional value available to eligible new customers shall not exceed $3,500 per location and shall depend on the applicable rack rate and equipment eligibility and availability.

Eligible existing EverPass customers who do not currently subscribe to NFL Sunday Ticket may receive forty percent (40%) off the NFL Sunday Ticket commercial rack rate for the Initial Term, up to a maximum discount of $2,500 per Authorized Location. Customer must maintain an active EverPass Core Subscription throughout the Initial Term to retain NFL Sunday Ticket promotional pricing. An active EverPass Core Subscription is required to access NFL Sunday Ticket via EverPass.

The discount applies only to the Subscription fees and does not apply to taxes, regulatory fees, shipping and handling, installation, or other charges. All applicable taxes and fees are the responsibility of Customer. The discount will be applied at invoicing or as a bill credit, as determined by EverPass. Limit one (1) promotional offer per Authorized Location. The Promotion may not be combined with any other offer, promotion, rebate, or discount unless expressly authorized by EverPass. Equipment provided under the Promotion is at EverPass’s sole discretion and is subject to availability. Regarding streaming devices provided under this Promotion, eligibility, quantities, and configurations are determined by EverPass in its sole discretion based on business type, fire code occupancy (FCO), technical requirements, and other operational considerations. All equipment provided at no charge under this Promotion remains subject to the Hardware provisions of the Master Subscription Agreement.

All Subscriptions and promotions are subject to the terms of the Master Subscription Agreement located at https://everpass.com/customer-msa/. NFL Sunday Ticket Subscriptions are also subject to the NFL Sunday Ticket Terms located at https://everpass.com/content-terms/.

The Promotion is non-transferable and not redeemable for cash, and any attempted assignment or transfer is void. EverPass reserves the right to verify compliance with these Promotion Terms and investigate suspected fraud or abuse at any time. EverPass may review Customer accounts to confirm ongoing compliance with these Promotion Terms. If EverPass reasonably determines that a Customer’s account reflects inaccurate information, including business type, fire code occupancy, location, or eligibility status, or otherwise does not meet the requirements of this Promotion or the Agreement, EverPass may adjust or discontinue promotional pricing and apply the then-current standard commercial rates, which may be applied retroactively to the start of the applicable Subscription Term. EverPass’s determination in such matters shall be final and binding.

NFL Sunday Ticket only includes out-of-market Sunday afternoon games and does not include games available in-market on local channels (CBS, FOX), NFL Network games, national NFL games, or select digital-only or international games. Customer’s NFL Sunday Ticket Subscription will automatically renew at the then-prevailing rate only if EverPass continues to distribute NFL Sunday Ticket at the time of renewal, unless Customer cancels in accordance with the NFL Sunday Ticket Terms. Customer’s EverPass Core Subscription will automatically renew in accordance with the Master Subscription Agreement and any other applicable Subscription terms at the then-prevailing rate unless Customer cancels in accordance with such terms. EverPass may communicate with Customer regarding this Promotion and related services via email, phone, or text message using the contact information provided. Customer hereby consents to receiving such communications, including via automated or prerecorded means. Customer may opt out of marketing communications at any time by contacting EverPass at support@everpass.com, but operational and transactional communications related to Customer’s account and Subscription will continue.
